Agreement to Terms

Welcome to AiHookr. These Terms of Use ("Terms") form a legally binding agreement between you ("you," "your," or "User") and AiHookr ("we," "our," "us," or "the Company") governing your access to and use of the AiHookr mobile application ("App"), available on the Google Play Store, and the website located at https://aihookr.com ("Website").

By downloading, installing, registering for, or using AiHookr in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not download or use the App. Uninstall it from your device immediately.

These Terms apply to all users of AiHookr, including free plan users, Pro subscribers, and Viral King subscribers.

1. Who Can Use AiHookr

1.1 Minimum Age

You must be at least 13 years of age to use AiHookr. If you are between 13 and 17 years of age, you must have the explicit permission of a parent or legal guardian to use the App. By using AiHookr, you represent and warrant that you meet the minimum age requirement.

We do not knowingly allow children under the age of 13 to create accounts or use AiHookr. If we discover that a user is under 13, we will immediately terminate their account and delete their data.

1.2 Legal Capacity

By accepting these Terms, you represent that you have the legal capacity to enter into a binding agreement. If you are using AiHookr on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

1.3 Geographic Availability

AiHookr is primarily designed for users in Bangladesh and South Asia. The App is available to users globally unless restricted by local laws. It is your responsibility to ensure that using AiHookr is legal in your jurisdiction.

2. Your Account

2.1 Account Creation

To access most features of AiHookr, you must create an account. You can register using your email address and password, your Google account, or your phone number with OTP verification. You agree to provide accurate, current, and complete information during registration and to keep that information updated.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You agree to notify us immediately at support@aihookr.com if you suspect any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to keep your account credentials secure.

2.3 One Account Per Person

Each individual may maintain only one AiHookr account. Creating multiple accounts to circumvent plan limits, abuse the free tier, or evade a suspension is strictly prohibited and will result in permanent termination of all associated accounts.

2.4 Account Deletion

You may delete your account at any time through the App's Settings section, through our website at aihookr.com/delete-account.php, or by emailing support@aihookr.com. Account deletion is permanent and irreversible. Please refer to our Privacy Policy for details on what data is retained after deletion for legal compliance purposes.

3. The AiHookr Service

3.1 What AiHookr Provides

AiHookr is an AI-powered content creation tool. The App provides the following core features depending on your subscription plan: a viral script generator that uses artificial intelligence to create Hook, Body, and Call-to-Action content for social media videos, a trending alerts feed showing real-time trending topics for South Asian creators, a hashtag generator that produces niche-specific viral hashtags, an AI caption writer for short-form video content, niche personalization tools, and a ViralGuru AI chatbot for creator support and advice.

3.2 AI-Generated Content

All scripts, hooks, captions, hashtags, chat responses, and other content produced by AiHookr's features are generated by artificial intelligence, specifically Google's Gemini AI model accessed through Firebase AI Logic. This content is clearly labeled as AI-generated within the App.

AI-generated content is a creative starting point and a tool to assist you. It is not guaranteed to be accurate, factually correct, legally compliant for every jurisdiction, or suitable for every purpose. You are solely responsible for reviewing, editing, fact-checking, and deciding whether to use any AI-generated content before publishing it publicly.

3.3 No Guarantee of Virality

AiHookr provides tools to help improve your chances of creating engaging and trending content. However, we do not guarantee that any content generated by AiHookr will go viral, reach any specific number of views, appear on any platform's For You page or Explore page, or generate any specific level of engagement, revenue, or followers. Social media platform algorithms are entirely outside our control.

3.4 Platform Compatibility

AiHookr generates content intended for use on TikTok, Instagram Reels, YouTube Shorts, Facebook Reels, and WhatsApp Status. Each of these platforms has its own terms of service and community guidelines. You are solely responsible for ensuring that content you post on those platforms complies with their individual rules and policies. AiHookr is not affiliated with, endorsed by, or sponsored by any of those platforms.

3.5 Service Availability and Changes

We aim to keep AiHookr available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted access. The App may be temporarily unavailable due to scheduled maintenance, emergency repairs, technical failures, or circumstances beyond our control. We reserve the right to modify, update, add, or remove features at any time.

4. Subscription Plans and Billing

4.1 Available Plans

AiHookr offers the following subscription plans:

  • Free Plan: Available at no cost. Includes 3 AI script generations per day, basic trending alerts, 5 hashtag packs per day, and access to 1 niche category. Includes rewarded video advertisements.
  • Pro Plan: Available at the price displayed in the App and on the Google Play Store (currently ৳149 per month). Includes 50 script generations per day, real-time trending alerts, unlimited hashtag packs, up to 5 niche categories, ViralGuru AI Chat access, and priority support.
  • Viral King Plan: Available at the price displayed in the App and on the Google Play Store (currently ৳249 per month). Includes unlimited script generations, all niche categories, 1-on-1 Viral Coach access, early feature access, and private community access.

4.2 Billing Through Google Play

All subscription purchases for AiHookr Pro and Viral King are processed exclusively through Google Play Billing. By purchasing a subscription, you agree to Google Play's payment terms and billing policies. We do not directly process or store your payment card information. All billing disputes must be directed to Google Play.

4.3 Automatic Renewal & Price Changes

Subscriptions automatically renew at the end of each billing period unless canceled. We reserve the right to change subscription prices with at least 30 days advance notice. The price change will take effect at your next renewal date.

4.4 How to Cancel

To cancel, open the Google Play Store app → tap your profile icon → Payments and subscriptions → Subscriptions → find AiHookr → tap Cancel subscription. Your subscription will remain active until the end of the current billing period.

4.5 Refunds & Failed Payments

All purchases are subject to Google Play's refund policy. We do not process refunds outside of Google Play's standard refund mechanism. If a payment fails, your subscription will be downgraded to the Free plan until payment is collected.

5. Acceptable Use Policy

You may use AiHookr only for lawful purposes. You agree that you will NOT use AiHookr for any of the following prohibited activities:

  • Illegal Content: Generate, distribute, or promote content that violates any applicable law.
  • Harmful Content: Generate content that promotes, glorifies, or incites violence, terrorism, or self-harm.
  • Hate Speech: Generate content that attacks, demeans, or discriminates against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
  • Child Exploitation: Generate any content that sexually exploits, grooms, endangers, or harms children in any way. (Zero tolerance policy — see Section 6).
  • Election and Anti-State Content: Generate content that spreads disinformation about elections, undermines democratic processes, or constitutes anti-state material under Bangladesh law.
  • Misinformation: Deliberately generate and spread false information, medical misinformation, or financial misinformation.
  • Intellectual Property Violations: Generate content that infringes upon copyright, trademark, or other IP rights.
  • Spam and Manipulation: Generate mass spam, engage in coordinated inauthentic behavior, or artificially manipulate social media metrics.
  • Impersonation: Falsely impersonate any real person, brand, or organization deceptively.
  • System Abuse: Circumvent limits, reverse engineer the app, use automated bots/scrapers, or attempt to breach system security.

6. Child Safety Standards

In full compliance with Google Play's Child Safety requirements, AiHookr explicitly prohibits Child Sexual Abuse and Exploitation (CSAE) in all forms.

  • We explicitly prohibit CSAE in these Terms of Use, which are publicly accessible.
  • We provide an in-app mechanism for users to report offensive, harmful, or inappropriate AI-generated content.
  • We take immediate action upon any report of CSAM, including removing the content and reporting it to the National Center for Missing and Exploited Children (NCMEC) or relevant regional authorities.
  • Our AI content safety filters are specifically configured to detect and block prompts that could endanger children.
  • Any user generating content that harms or sexualizes children will be permanently banned and reported to law enforcement.

7. AI-Generated Content and Intellectual Property

7.1 Ownership & Licensing

Content generated by AiHookr is produced based on your inputs. Subject to your compliance with these Terms, you own the content generated in response to your prompts. By using AiHookr, you grant us a limited, non-exclusive license to store and process your inputs solely to provide the service.

7.2 No Guarantee of Uniqueness

Because AiHookr uses large language models, similar or identical outputs may be generated for different users. We do not guarantee that content is unique or exclusive to you.

7.3 App IP & Third-Party Rights

The AiHookr app, code, logo, and interface are our intellectual property. You are responsible for ensuring that the content you create (e.g., using real names or brands) does not infringe on third-party intellectual property rights.

8. User Reporting and Content Moderation

In compliance with Google Play's AI-Generated Content Policy, AiHookr provides an in-app mechanism for users to report or flag AI-generated output they believe is offensive, harmful, illegal, or violates these Terms. Tap the flag icon on any output screen or go to Settings → Report a Problem.

We review reported content and may improve filters, block prompts, or terminate offending accounts. We are not liable for content users choose to publish externally.

9. Disclaimers and Limitation of Liability

Service Provided As Is: AiHookr is provided "as is" without warranties of merchantability, fitness for a particular purpose, or accuracy.

Limitation of Liability: To the maximum extent permitted by law, AiHookr shall not be liable for indirect, incidental, special, or consequential damages (including loss of profits or data) arising from your use of the App. Our total aggregate liability shall not exceed the amount paid in subscription fees in the preceding 12 months, or ৳500, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless AiHookr and its affiliates from any claims, liabilities, damages, and expenses (including legal fees) arising from your use of AiHookr, your violation of these Terms, or content you generate and publish using the App.

11. Termination

You may stop using AiHookr at any time. We reserve the right to suspend or permanently terminate your account without notice if you violate these Terms, engage in fraud, or pose a risk to the platform. For severe violations (like CSAM or hate speech), termination is immediate. Upon termination, you lose access to all saved data. Sections regarding IP, Liability, and Indemnification survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of Bangladesh. We encourage informal dispute resolution first by contacting support@aihookr.com. Unresolved disputes shall be subject to the exclusive jurisdiction of the competent courts of Dhaka, Bangladesh. You agree to resolve disputes on an individual basis, waiving class action rights where permitted.

13. Changes to These Terms

We may update these Terms at any time. Material changes will be notified via the App or push notifications. Continued use of AiHookr after updates constitutes your acceptance of the revised Terms.

14. General Provisions

These Terms, along with the Privacy Policy, constitute the entire agreement. If any provision is found unenforceable, it will be severed without affecting the remaining provisions. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent.
